Terms of Service

Acceptance of These Terms

These Terms of Service (the “Terms”) are a binding agreement between you and Soul Surferz LLC (“Soul Surferz,” “we,” “us,” or “our”). They govern your access to and use of the website at soulsurferz.co and our mobile applications, including VibeSesh, Smush, Gleamr, Mindara, and VEX (each, an “App,” and collectively the “Services”). By creating an account, downloading an App, or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Services. Some Apps are rated for adults only and require you to be 17 or older; the age rating shown on each App's App Store listing controls for that App. By using the Services you represent that you meet the applicable age requirement and that you have the legal capacity to enter into these Terms.

Your Account

You are responsible for the activity that occurs under your account. Keep your credentials confidential, and let us know right away if you suspect unauthorized access.

We may suspend or terminate your account at any time if you violate these Terms, abuse the Services, or pose a risk to other users or to us.

Subscriptions and Payments

Some Services are sold as auto-renewing subscriptions or one-time in-app purchases through the Apple App Store. By subscribing, you authorize the App Store to charge your payment method on the renewal schedule shown at checkout until you cancel.

You can manage or cancel a subscription at any time through your App Store account settings. Cancellation takes effect at the end of the current billing period.

Refunds are handled by Apple under the App Store's refund policy. Free trials, where offered, automatically convert to a paid subscription unless you cancel before the trial ends.

Acceptable Use

You agree not to:

  • Use the Services in violation of any applicable law or regulation
  • Upload, generate, or share content that is unlawful, abusive, harassing, threatening, defamatory, infringing, or that depicts minors in a sexualized way
  • Impersonate any person or misrepresent your affiliation with a person or entity
  • Reverse engineer, decompile, scrape, or attempt to extract source code from the Services, except where the law expressly permits it
  • Interfere with the Services, probe them for vulnerabilities, or attempt to gain unauthorized access to any account or system
  • Use the Services to send spam, run mass automated activity, or otherwise harm other users

Your Content

You retain ownership of any content you create or upload through the Services (“Your Content”). You grant Soul Surferz a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, and display Your Content solely for the purpose of operating and improving the Services for you.

You are responsible for Your Content and represent that you have the rights necessary to upload and use it.

AI-Generated Output

Several of our Apps use AI to generate content (audio, affirmations, images, or text) based on your input. AI output can be imperfect, surprising, or factually wrong. Do not rely on AI output for medical, legal, financial, or other professional advice. Soul Surferz is not responsible for decisions made based on AI-generated output.

Intellectual Property

The Services, including their software, design, logos, and content (other than Your Content), are owned by Soul Surferz or its licensors and are protected by copyright, trademark, and other laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Services for your own non-commercial use, in line with these Terms.

Third-Party Services

The Services rely on third-party providers (including Apple, Supabase, RevenueCat, OpenAI, Anthropic, Google, and Meta) and may link to or interoperate with third-party websites. Your use of those services is governed by the third party's own terms and privacy notices, and we are not responsible for them.

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SOUL SURFERZ DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SOUL SURFERZ AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL ARISING FROM OR RELATED TO THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AND (B) US $50.

Indemnification

You agree to defend, indemnify, and hold Soul Surferz harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your misuse of the Services, your violation of these Terms, or your violation of the rights of a third party.

Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

Termination

You may stop using the Services at any time and may delete your account by following the steps on our Data Deletion page. We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or for any other reason in our reasonable discretion. Provisions of these Terms that by their nature should survive termination will survive.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Effective” date at the top of this page. Material changes will be communicated through the Service or by email where appropriate. Continued use of the Services after changes take effect means you accept the updated Terms.
